Fresh & Lush Foods would like your event to be a great success and the best way to achieve this is to create a strong, open relationship with you, where communication is clear and expectations from both sides are understood from the beginning.
Standard Terms and Conditions for Catering by Fresh & Lush Foods
The client should note that business conducted with Fresh & Lush Foods is conducted on the basis of our standard terms and conditions.
Following our discussions Fresh & Lush Foods will provide you with an individual written quotation. It will remain valid for your particular event date. In the instance that the event brief alters, it may be necessary to review and update the quotation.
Fresh & Lush Foods services are hired under the terms and conditions set out below. The payment by any person of any fees and charges for such services shall be deemed to be an acknowledgment and acceptance by such person of these conditions. When the deposit (or full payment) is submitted, a signed copy of the Terms and Conditions should be supplied to confirm this.
Confirmation of your event will be upon receipt of the requested deposit. Failure to provide one may result in Fresh & Lush Foods cancelling the event.
The client must advise Fresh & Lush Foods, in writing, the final numbers of guests attending not less than 14 days prior to the event. We will also require other details at this stage including menu choice, meal timings and table plan, if they have not been given already. If the number’s increase these may be added as required prior to the function and charged for accordingly. Guests who do not attend and/or unbooked guests who attend will be added to the invoice.
A “Non Refundable/ Non Transferable Booking fee” of 20% of the estimated bill is required immediately to secure the booking.
100% of the outstanding estimated bill (less the 20% booking fee) is payable not less than 10 days prior to the event.
In the event that the client cancels their order they must contact Fresh & Lush Foods by telephone in the first instance, and then send confirmation by email. The order will only be cancelled when the customer is in receipt of a Cancellation Acceptance, which will be an email from Fresh & Lush Foods.
Fresh & Lush Foods will make a charge for cancelled bookings calculated at a percentage of the total booking value. For these purposes the total booking value shall be calculated in accordance with the number notified by the client to Fresh & Lush Foods in the information of booking:
Cancellation Period Charge
Cancellation less than 3 months prior to the event 20% of the total booking value
Cancellation less than 2 months prior to the event 40% of the total booking value
Cancellation less than 20 days 80% of the total booking value inclusive prior to the event
Where circumstances beyond Fresh & Lush Foods’ control prevent us from fulfilling any obligations, Fresh & Lush Foods will, by notice in writing to the client, terminate the Contract and return to the client any balance of the Payment on Account remaining after settlement of all or any costs, expenses or liabilities howsoever incurred in respect of the proposed provision of the Services.
Fresh & Lush Foods does not handle or serve any food other than supplied by Fresh & Lush Foods (except celebration cakes).
Fresh & Lush Foods have appropriate Public Liability Insurance. Fresh & Lush Foods advise that all food must be consumed after two hours of initial serving. Any food consumed two or more hours after first being served is at the client’s discretion and therefore becomes their responsibility.
Fresh & Lush Foods reserve the right to substitute suitable alternative menu items, should prevailing circumstances dictate this.
Fresh & Lush Foods shall not be responsible for any personal effects at the event.
Fresh & Lush Foods reserve the right to charge for any broken, damaged or lost equipment during the event, or any loaned equipment broken, damaged or lost.
